Trial Team Wins $10 Million for Rape Victim
Savage, Turner, Durham, Pinckney & Savage partner, former federal prosecutor Jim Durham leads winning team
“Write down a number that you think is fair, and then keep adding zeros.”
In his first case since returning to private practice, Jim Durham made his closing argument. The Chatham County jury did exactly what Mr. Durham asked. They awarded an eight figure verdict – $10,000,000 – to the victim of a violent sexual assault.
The jury determined that a corporate defendant – SSU Foundation Real Estate Ventures, LLC – was negligent by failing to provide reasonable security.
After leaving his post as the Acting United States Attorney for the Southern District of Georgia, Mr. Durham’s first win on the plaintiff’s side feels familiar. He’s still serving the victims of misconduct.
“We’re trying to make something better for the victim here,” Mr. Durham said. “But the result will hopefully protect others as well.”
Kathryn Pinckney handled critical motions in trial on behalf of the Plaintiff. Closing the door on the defendant’s attempt to escape liability, Ms. Pinckney’s advocacy defeated motions for a directed verdict at the close of evidence.
The result and details of the case were featured in an article, “Savannah Jury Awards $10M to College Student Raped at Gunpoint,” by Katheryn H. Tucker of the Daily Report.
“Our client deserves every bit of it,” Mr. Durham said in an interview with the Daily Report.
“She had to relive on the stand 30 minutes of hell.”
Jim Durham and Kathryn Pinckney of Savage, Turner, Durham, Pinckney & Savage tried the case with Abda Lee Quillan of the Tate Law Group.
